Buyers’ rights and obligations

These notices apply to purchases via the it-shop.rs online store operated by ITMATHICS DOO BEOGRAD-ZVEZDARA (the “Seller”). Rights differ depending on whether the buyer is a consumer (a natural person) or a legal entity / entrepreneur.

A. Buyer — consumer (natural person)

The Consumer Protection Law applies to consumer purchases.

  1. Conformity of goods. The Seller is liable for any lack of conformity of the goods with the contract for two years from the transfer of risk to the consumer (delivery of the goods). If a lack of conformity appears within the first six months, it is presumed to have existed at the time of delivery, unless the contrary follows from the nature of the goods or the lack of conformity. For used goods, the period is one year.
  2. Remedies for lack of conformity. The consumer may require the lack of conformity to be remedied by repair or replacement free of charge, and chooses between repair and replacement. If a remedy is not possible, the consumer is entitled to a price reduction or to terminate the contract. Termination is not available where the lack of conformity is minor.
  3. Right of withdrawal (14 days). The consumer may withdraw from a distance contract within 14 days without giving reasons (details: the Withdrawal page).
  4. Complaints. Complaints are submitted as described on the Complaints page. The Seller responds without delay, no later than 8 days, and resolves the complaint within 15 days, or 30 days for technical goods. The consumer is also entitled to out-of-court dispute resolution.

B. Buyer — legal entity or entrepreneur (B2B)

Purchases by legal entities and entrepreneurs are governed by the Law on Obligations, not by the Consumer Protection Law. This means:

  1. The 14-day right of withdrawal does NOT apply. Unilateral termination without cause applies only to consumers — natural persons.
  2. Inspection of goods and notice of visible defects. The Buyer must inspect the received goods without delay and notify the Seller of any visible defects within 8 days at the latest, failing which the Buyer loses its rights on that basis.
  3. Hidden defects. The Buyer must notify the Seller of hidden defects without delay upon discovery. The Seller is not liable for defects appearing after six months from delivery, unless a longer period is agreed in the contract.
  4. Buyer’s remedies. On the basis of a defect, the Buyer may require the defect to be remedied or the goods replaced, a price reduction, or termination of the contract in accordance with the Law on Obligations. Termination is not available for minor defects.
  5. Manufacturer’s warranty. Warranty rights are exercised in accordance with the warranty card.

What is not covered by conformity and warranty

Liability for conformity and the warranty do not cover defects and damage arising after delivery of the goods to the buyer that are not attributable to the Seller or the manufacturer, in particular:

  • mechanical, chemical or other physical damage occurring after receipt of the goods;
  • damage caused by improper use, installation or maintenance contrary to the manufacturer’s instructions;
  • damage caused by faulty electrical installations, unstable voltage or power surges;
  • damage caused by force majeure (flood, fire, earthquake, lightning strike, etc.);
  • damage caused by the use of non-original consumables, chargers, adapters or cables not purchased with the product;
  • damage caused by unauthorized repair or modification by a person who is not an authorized service center;
  • normal wear of consumable parts (batteries, etc.) within their usual service life;
  • defects caused by use in conditions that do not meet the manufacturer’s specifications.

The Seller is not liable for the loss of data on computers, drives and other data-storage devices. We recommend backing up your data before handing a device in for service.

This exclusion does not affect the consumer’s statutory conformity rights under the Consumer Protection Law.
